Cody Schaefer, a truck driver and mechanic from Rapid City, S.D., meets his former wife in Kansas City every year to get his three children for summer vacation.
Cody Schaefer said Tyler, a Cub Scout, is always on the lookout for clues and treasure.
"He looks for stuff at random," Schaefer said of his son. "He's very observant."
Schaefer said after they checked into their room Saturday, Tyler began opening all the drawers, and it wasn't too long before Tyler announced: "I found money!"
Schaefer thought maybe his son had found a forgotten $10 bill, but when he looked closer he saw the stack of bills totaling $10,000. He wondered if the bills were fake, but saw they had the appropriate watermarks and seemed legitimate.
"We didn't know what to do at first," Schaefer said.
Schaefer told his son they couldn't keep the cash because they didn't know who it belonged to. They handed the money over to two off-duty police officers working security at the hotel. The officers contacted Sgt. Randy Francis, a property and evidence supervisor, who stored the cash at a police facility.
Police said it's unclear how long the money had been there, and they can't track down every guest who stayed in that room recently. Police spokesman Capt. Tye Grant said Thursday no one had claimed the money yet.
According to a Missouri statute, lost money could revert to a finder after about seven months if no one can prove ownership. But the owner then has another year to prove the money is his or hers and claim it from the finder.
"I didn't come there with $10,000 and I didn't leave with $10,000," Cody Schaefer said. (NASDAQ: AAPL) has filed a $53 million preliminary class settlement agreement in the U.S. District Court in San Francisco, potentially allowing $200 refunds to iPhone and iPod Touch customers who claim they should be covered under warranties but were not because of liquid indicators in their devices.
A group of four class representatives were upset over Apple's liquid damage policy prior to Dec. 31, 2009, in which the company would deny coverage under the standard warranty and purchased AppleCare Protection Plan for an iPhone whose headphone jack or dock connector was pink or red, indicating water contact, and for an iPod Touch with the same description before June 30, 2010.
Apple iPhone and iPod Touch users who were covered under a warranty, brought in devices before those dates and were denied repairs or replacements because of a pink or red indicator will be able to go to a website for class members after judicial approval is given.
Jeffrey Fazio, an attorney representing two of the four class representatives, said he expected judicial approval in the next 30 days.
"They're both delighted, as are we," Fazio said of his clients. "We think it's a very good settlement. We think people will get real money and real relief."

Requests for comment to Apple and its attorneys were not returned.
The company has not acknowledged any wrongdoing in the settlement.
The movement to build a class started in April 2010, when Charlene Gallion filed a lawsuit against Apple in U.S. District Court. She and her attorneys proposed that they represent all purchasers of iPhones and iPod Touches in the country.
Apple's former liquid damage policy was changed around December 2009 for iPhone and June 2010 for the iPod Touch. The company then said that a warranty claim should not be denied based solely on a triggered headphone jack or dock liquid contact indicator.
Fazio said the issue with Apple's former policies was that company employees would allegedly base the decision to repair or replace a device based on the indicator without fully inspecting the device.
"If then they find after inspecting them internally, as we allege they should have done from the beginning, they find water damage, frankly, we don't find anything wrong with it," Fazio said.
Now, company employees first ask customers if a device has been damaged by water, then inspect the device, Fazio said.

So far, Fazio said, there are about 150,000 identifiable people who are a part of the class.
"They'll remember. I guarantee it," Fazio said of the potential claimants. "People who spend that much on a device and have to buy another one for reasons they don't believe were valid -- they tend to remember."
Fazio said his team already has contact information for about 130,000 class members. Those Apple customers will not have to submit a claim for reimbursement from the settlement fund and will receive a check, unless they opt out of the settlement class.
Depending on the final number of claims, people could receive about $200 from the $53 million settlement. If the fund is not fully utilized by claimants, the remaining funds will go to non-profit groups and consumer organizations, Fazio said.
Public records show that the agreement was filed on Tuesday, after an initial copy of Apple's agreement was leaked by Wired last month.
According to the document, "liquid contact indicator" is the name Apple used from Dec. 22, 2009 to describe a water contact indicator tape it purchased from the 3M Company and installed in iPhone 3G and iPhone 3GS.
"They weren't designed to detect damage to an electronic device," Fazio said of the indicators. "What they were designed to do is alert a company that there may be a problem. And if they saw that, opened the device and inspected it and actually found a problem, we wouldn't have filed suit."

Apple $53M settlement news via abcnewsUnknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-337230236546960122013-05-30T09:02:00.000-07:002013-05-31T08:11:59.308-07:00Receptionist to CEOReceptionist to CEO, Karen Kaplan, the CEO of advertising firm Hill Holliday, had humble beginnings. The Dallas County jury took about three and a half hours to sentence Naim Rasool Muhammad. The same jury took less than 10 minutes last week to find him guilty of capital murder in the deaths of 5-year-old Naim and 3-year-old Elijah.

"I apologize for bringing any pain and hurt on anybody for the actions that I have caused to you all," Muhammad said after the sentence was announced. He said that the only reason he did it was because he wanted to be a father and thought that was being taken away.

Muhammad killed Naim and Elijah in August 2011. Authorities say he forced the boys and their mother, Kametra Sampson, into a car and started driving on what was supposed to be Naim's first day of school. "You've shown that you have no boundaries, that nothing is sacred to you -- not even the bond between a father and son," Sampson said after the verdict was announced.

In closing arguments, prosecutor Tammy Kemp called Muhammad "a monster" and "100 percent pure evil." That angered Muhammad's mother, who stood up and shouted, "That is not a monster. He is my son." She bolted from the courtroom but could be heard shouting in the corridor outside as Kemp resumed her closing argument.

Defense attorney Paul Johnson told jurors that the children's deaths were, indeed, a horrible crime -- one deserving of life imprisonment without parole. He told jurors that Muhammad's neglect by a mother who was a crack-addicted prostitute and upbringing amid violence and sexual abuse warped him. That, Johnson said, was sufficient mitigation to spare him the death penalty.

"If it's not this case, what is it?" he said. "He is not evil, but he has committed an evil act."

Confession, Quick Judgment

During a taped confession from an interview with investigators that played in court May 14, Muhammad confessed to the murders.

The video showed Muhammad telling investigators that he told the children to pretend they were swimming and then held them underwater until they drowned. As the interview played, the defendant sobbed so loudly it could be heard in the hallway.

Jurors took less than 10 minutes the following day to convict Muhammad of capital murder.

Prosecutors said Muhammad is a threat to society and that there is no reason he should be allowed to live.

"I don't have to recall the facts of the case because, although it was not filled with blood or gore, it was a horror unimagined," prosecutor Sherre Sweet said.

Muhammad, who has a criminal record spanning 20 years, killed his sons after their mother began dating someone new, prosecutors say.

"It was the ultimate textbook family violence power and control play -- 'If I can't get you to do what I want you to do through violence, I will go to your very heartstrings,'" Sweet said.

Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-55452712108200727412013-05-24T00:50:00.000-07:002013-05-31T08:11:59.722-07:00S.W.A.T. star diesS.W.A.T. star dies, TV and movie star Steve Forrest, best remembered for his role on the Aaron Spelling-produced cop drama "S.W.A.T.," died May 18 at his home in Thousand Oaks, California, at age 87.
"S.W.A.T." aired for just two seasons on ABC in 1975-76, but the concept proved so popular that a big-screen adaptation starring Colin Farrell and Samuel L. Boedigheimer and Grove are the creators of the animated series "Annoying Orange."
H2M alleges Boedigheimer and Grove ripped off a copyrighted character called The Talking Orange that was created for television commercials for the North Dakota Department of Transportation. The commercials aired in North Dakota and western Minnesota from 2005 to 2010. The lawsuit also names Annoying Orange LLC and Annoying Orange Inc., both based in California.
"Defendants Dane Boedigheimer and Spencer Grove were raised, resided, educated, attended film school, were employed and first obtained access to 'The Talking Orange' in North Dakota and western Minnesota — the same area where Plaintiff H2M's 'The Talking Orange' and its derivatives, were widely disseminated on cable television," the suit states.
The Talking Orange is comprised of an inanimate orange that has a superimposed mouth with lips, tongue and teeth. An actor's mouth speaking the character's part is composited onto the orange. It has a "snotty, annoying and slightly obnoxious" voice, which gives it an abrasive and abusive persona, the lawsuit stated.
"Like 'The Talking Orange,' 'Annoying Orange' appears to be speaking with a 'voice' that is perfectly in sync with the movement of the actor's mouth, lips, teeth and tongue," according to the lawsuit.
Boedigheimer and Grove are both North Dakota natives and attended college at Minnesota State University-Moorhead before relocating to California, the lawsuit said. Both still have family members in North Dakota and western Minnesota.
H2M is seeking damages, an injunction prohibiting Boedigheimer and Grove from profiting off their product, and attorneys' fees.
A representative of Boedigheimer and the producers of the show said she could not comment on current litigation. A spokeswoman for Cartoon Network also said the channel had no comment.

Cartoon Network lawsuit news Via news yahoo Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-33405324876608426222013-05-23T09:16:00.000-07:002013-05-31T08:12:00.011-07:00Bad Teacher to CBS
Bad Teacher to CBS, "Bad Teacher" is coming to TV.
On Wednesday, CBS announced it had ordered the single-camera comedy, based on the Cameron Diaz-starring film, for the 2013-2014 television season.

Ari Graynor stars in the series as "an always inappropriate, fearless and unapologetic former trophy wife who masquerades as a teacher in order to find a new man after her wealthy husband leaves her penniless," per CBS.

Ari previously played Caitlin, Meadow Soprano's troubled college roommate in HBO's "The Sopranos." "If the state is going to put Bibles in the cabins, they must allow alternate points of view – all alternative points of view without taking sides."
But it was not at all clear Monday whether the atheist literature would find a place in the cabins alongside the Protestant Bibles.
Asked if the state would allow it, Brian Robinson, a spokesman for Gov. Nathan Deal, would only say that the governor's office is working on regulations governing the distribution of materials with the Department of Natural Resources and the Attorney General's Office.
Silverman says he's expecting the state's decision to take no longer than it did for Deal to order the Bibles' return.
"There are lots and lots of atheists in Georgia, and there are lots of atheists who visit Georgia," Silverman said.
One of those atheists, Ed Buckner, was not happy last month when he discovered nine Gideon Bibles in the cabin he had rented with his family at Amicalola Falls State Park in north Georgia. When he complained, park managers removed the Bibles while they sought a legal decision from the Attorney General's Office.
The AG determined the state was on firm legal ground because it hadn't paid for the books. That prompted Deal last week to order the Bibles returned to the cabins at Amicalola and other state parks. In announcing the decision, the governor said any religious group was welcome to donate literature.
Silverman's group responded soon afterward.
"We appreciate the governor's invitation to place atheist books in the cabins and look forward to providing visitors with the opportunity to learn more about atheism when they visit Georgia's beautiful state parks," American Atheists Managing Director Amanda Knief said in a statement.

Atheist books next to Bibles news Via huffingtonpostUnknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-73942346335229618572013-05-21T05:35:00.000-07:002013-05-31T08:12:00.299-07:00Pot-eating pigsPot-eating pigs, With Washington state about to embark on a first-of-its-kind legal market for recreational marijuana, the budding ranks of new cannabis growers face a quandary over what to do with the excess stems, roots and leaves from their plants.

Susannah Gross, who owns a five-acre farm north of Seattle, is part of a group experimenting with a solution that seems to make the most of marijuana's appetite-enhancing properties - turning weed waste into pig food.
Four pigs whose feed was supplemented with potent plant leavings during the last four months of their lives ended up 20 to 30 pounds heavier than the half-dozen other pigs from the same litter when they were all sent to slaughter in March.
"They were eating more, as you can imagine," Gross said.

Giving farm animals the munchies is the latest outcome of a ballot measure passed by Washington voters in November making their state one of the first to legalize the recreational use of pot. The victim is a woman who told police she has a 10-year-old son whose father is Williams.
The woman told police that Williams had a scheduled visitation exchange with the boy on Sunday, and during the exchange in a downtown Kent parking lot, the two began arguing. The woman told police that Williams brandished a firearm and made threats. He then left the area.

Police later found Williams and took him into custody "without incident," terming the situation "a domestic violence case under investigation."

Williams has largely underwhelmed in his four-year professional career, failing to live up to the significant promise the 6-foot-6 combo guard possessed when the then-New Jersey Nets selected the tantalizing Louisville product with the 11th pick in the 2009 NBA draft.
After a relatively quiet start to his career in New Jersey, Williams came on strong late in the season, earning more minutes on the struggling club and showcasing an intriguing all-around floor game, averaging just under 12 points, six rebounds and 4.5 assists per game after the All-Star break. The honeymoon didn't last long, though, as Williams spent Summer League and preseason gunning, started the 2010-11 season by showing up late for practices and testing the patience of Nets coach Avery Johnson, earning a two-game suspension that was followed by a first-of-its-kind D-League demotion. Shortly thereafter, the Nets shipped him off to the Houston Rockets in a three-team deal; Williams would struggle to crack Houston's rotation, making only 23 appearances over two seasons for the Rockets before being waived in March 2012. He finished out the 2011-12 season with the Sacramento Kings, but was let go after a relatively nondescript 18-game stint in Northern California, and headed off to China after failing to catch on with any club heading into this past season.
Their roster decimated by injuries — especially in the backcourt, where they lost both starter Rajon Rondo and reserve Leandro Barbosa to season-ending injuries — the Celtics gave Williams another shot after he'd wrapped his stint with the Guandong Southern Tigers, signing him to a 10-day deal in February and offering him a chance to work his way back into the NBA. Williams performed well enough in limited duty as a backup point guard, averaging 4.6 points, 1.8 rebounds and 1.6 assists in 13.3 minutes per game in 24 regular-season appearances for Doc Rivers' squad. Boston signed Williams for the remainder of the 2012-13 season and the 2014 season following the expiration of his initial 10-day deal, but his '13-'14 veteran minimum contract is wholly unguaranteed, according to ShamSports.com's salary database.
In an April interview with CSNNE.com's Jessica Camerato, Williams expressed gratitude at getting another NBA chance and having the opportunity to dispel the league-wide notion that, despite his skill-set and athleticism, his character issues make him the kind of prospect best viewed from a distance.

"I have to prove everything," he said matter-of-factly. "What have I proved? Nothing. I just proved I can wear number 55 and some funny looking shoes. I feel like I’m starting over. I feel like I’m turning 21 again on Draft Night and just getting drafted. To me, to be honest, I feel like I have to prove everything."

Celtics player arrested news via sports.yahooUnknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-9342819933051135092013-05-21T05:22:00.000-07:002013-05-31T08:12:00.492-07:00Linkin Park frontmanLinkin Park frontman, Attendees at KROQ Weenie Roast in Los Angeles this weekend were treated to a surprise performance by the Stone Temple Pilots' new frontman, Linkin Park's Chester Bennington, Rolling Stone reported Sunday.
According to NME, Bennington and the Stone Temple Pilots played a new song, "Out of Time," along with older tracks "Sex Type Thing" and "Vasoline."
"I’ve loved STP since I was 13 years old and they’ve had a huge influence on me," Bennington said in a statement, in which he also emphasized his continued relationship with Linkin Park.

When the opportunity came up to do something creative with them, I jumped at the chance. All of my mates are looking forward to this big production,” Sepulveda said. “Banderas is very charismatic. I like him a lot and I think this movie is going to make him even more famous than he already is.”
Even in their despair, Sepulveda said, “peace, love, solidarity and teamwork” were shared by the miners who survived entrapment longer than anyone else before.
“There are people who don’t realize the value of what they have next to them. And after those 69 days we know that there’s nothing as important as being alive, being healthy and enjoying the people you love while you’re alive,” he said.
The miners said it felt like an earthquake when the shaft caved in above them on Aug. 5, 2010, filling the lower corridors of the copper and gold mine with suffocating dust. Hours passed before they could even begin to see a few steps in front of them. Above them tons of rock shifted constantly, threatening to bury them forever.
People on the surface didn’t know for more than two weeks that the men had survived the collapse. The 33 men had stretched a meager 48-hour store of emergency food for 17 days, eating tiny capsules of tuna and sips of expired milk while a narrow shaft finally reached their haven and the world learned they were alive.
The small emergency shaft allowed food and water to be lowered to the miners while rescuers drilled a bigger escape hole. Finally, in the early hours of Oct. 13, the miners were hauled up one-by-one in a cage through 2,000 feet of rock.
Back on the surface they were received as heroes. They got paid trips to the Greek Islands, visited the Real Madrid stadium in Spain and paraded at Magic Kingdom in Disney World.
But the fantasy began to crumble on their return home.
Many ran out of money and had to scratch out a living in the dusty working-class neighborhoods and shantytowns of the desert city of Copiapo. Some began suffering from health and psychological problems. Others took to alcohol and drugs. Most are still kept up at night by memories of their ordeal.
“I’m thankful for things in life,” said Sepulveda, an electrician who earns a living giving motivational speeches. “Some are good, others bad, but God gave us another chance ... The door that was opened for us is huge.”
Variety magazine say production for “The 33” is scheduled to start in the fall in Chile. The film will be directed by Mexican filmmaker Patricia Riggen. Martin Sheen and Rodrigo Santoro are also on the cast.

Banderas 'Super Mario' news Via washingtonpost Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6037797846306370709.post-39481985128389255282013-05-15T08:30:00.000-07:002013-05-31T08:12:00.685-07:003,500 potential witnesses3,500 potential witnesses, Court documents say prosecutors in the Colorado theater shootings have listed about 3,500 potential witnesses they could call during the trial of defendant James Holmes.

The estimate was in a motion filed Tuesday.
